Welcome to the A & A Cooling & Heating website. By accessing or using this site, submitting a form, calling us from a number on this site, or requesting services, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, please do not use the site. These Terms govern website use; workmanship, warranties, and pricing for performed HVAC work are governed by your written estimate, work order, or service agreement, which controls if it conflicts with these Terms for that job.

Our Services

A&A accepts inquiries for residential HVAC and for commercial work that passes an equipment, building, access, and location fit check. Service availability, credentials, scheduling, scope, and pricing are confirmed by the office and in the applicable written agreement. This website itself does not create a binding service commitment.

Use of the Site

Content on this site is provided for general information about our HVAC services. It is not a binding quote, code inspection, engineering advice, or a substitute for an on-site assessment by an appropriately qualified professional. Every job is confirmed in writing before work begins. You agree to use the site lawfully and in good faith, and not to misuse our forms, systems, or content.

Interactive Tools & Automated Guidance

Quizzes, diagrams, calculators, symptom selectors, chat or AI-assisted text, and other automated website features are educational triage tools only. They do not inspect equipment, diagnose a fault, guarantee safety, establish code compliance, or replace an on-site evaluation. If you smell gas, receive a carbon-monoxide alarm, see smoke or fire, or face another immediate danger, leave the area and contact the appropriate emergency service or utility before relying on website content.

Estimates, Scheduling & Promotions

Requests submitted through this site are not confirmed appointments until a member of our team contacts you. Appointment windows are estimates and may shift due to emergency calls, weather, or job conditions; we will make reasonable efforts to notify you of delays. Pricing shown in promotions is subject to the stated terms, qualifications, and availability. Ask the office to confirm eligibility and any combination restrictions before work begins.

SMS, Calls & Electronic Communications

If you expressly provide a mobile number and consent to text messages, A&A or its service providers may send messages related to your request, appointment, account, or any separately selected marketing program. Consent to marketing texts is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to opt out and HELP for help where those commands are supported. Transactional messages needed to complete a request may continue as permitted by law. Do not rely on text or email for an emergency.

Financing & Maintenance Plans

Financing, when offered, is provided through third-party lenders such as GoodLeap. Credit decisions, rates, and terms are between you and the lender. A & A Cooling & Heating does not guarantee approval. Cool Club and other maintenance plan terms are disclosed at enrollment and in plan materials.

Customer Responsibilities

You are responsible for providing accurate contact, address, equipment, access, ownership or authorization, and hazard information; securing pets; disclosing known asbestos, mold, electrical, structural, roof, code, tenant, or site-access concerns; providing safe and lawful access; reviewing estimates before approval; following operating and safety instructions; and paying amounts due under the signed agreement. Additional work caused by concealed conditions or inaccurate information requires separate approval where applicable.

Disclaimer of Warranties

This site and all content on it are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted operation, to the fullest extent permitted by Arizona law.

Warranties for installed equipment and performed work, if any, are stated exclusively in your signed service agreement and in applicable manufacturer warranties. Nothing in these Terms limits warranty rights you have under a signed agreement or rights that cannot be disclaimed under applicable law.

Limitation of Liability

To the fullest extent permitted by Arizona law, A & A Cooling & Heating and its owners, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the site or these Terms — including lost profits or data — even if advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the site or these Terms will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid us for the specific service giving rise to the claim in the twelve months before the claim arose.

Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence, willful misconduct, or personal injury or property damage caused by our on-site service work to the extent a signed service agreement or applicable law provides otherwise.

Delays & Events Beyond Control

To the extent permitted by law and the applicable written service agreement, A&A is not responsible for delay or nonperformance caused by events reasonably outside its control, such as severe weather, utility interruption, emergency call volume, supply-chain disruption, manufacturer delay, labor disruption, government action, unsafe site conditions, or unavailable access. The office will communicate a revised next step when reasonably possible.

Intellectual Property

The A & A Cooling & Heating name, logo, Learning Center and Blog content, photographs, and site materials are the property of A & A Cooling & Heating (or our licensors) and are protected by copyright, trademark, and other laws. You may not copy, republish, scrape, or create derivative works from site content, or use our name or logos, without our prior written permission. All rights not expressly granted are reserved.

User Submissions & Reviews

If you submit content through the site — form messages, photos, reviews, or feedback — you grant us a non-exclusive, royalty-free license to use that content to respond to you, perform services, and (with your permission) for marketing such as testimonials. You represent that your submissions are accurate and do not violate others’ rights.

Third-Party Links & Tools

The site may link to or embed third-party services (scheduling, financing, payment, review platforms, manufacturers). We do not control those parties and are not responsible for their content, terms, or privacy practices.

Dispute Notice & Informal Resolution

Before filing a claim about website use, send a written notice describing your name, contact information, the relevant transaction or page, the facts, and the requested resolution to [email protected] and 386 S Ironwood Dr, Apache Junction, AZ 85120. The parties should attempt good-faith informal resolution for 30 days after receipt unless immediate filing is required to preserve a legal right. A signed service agreement may contain a different or additional dispute process and controls for that job.

Governing Law & Disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law rules. You agree that exclusive venue for disputes arising from website use lies in the state or federal courts located in Maricopa or Pinal County, Arizona, unless a different venue is required by a written service agreement. This choice of law does not deprive you of mandatory consumer protections that apply notwithstanding a choice-of-law clause.

Severability & Changes

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. We may update these Terms from time to time. The effective date above will change when we do. Continued use of the site after updates constitutes acceptance of the revised terms.
